Breeches of the Charity Act 2006 by the University of Wales Lampeter

Dear Ms Stokes

I am writing further to my reports of breeches of the Charity Act 2006 by the University of Wales Lampeter in preparation of a formal complaint when the Charity Commission assumes its role as regulator later this year. I would be grateful if you would keep me informed when procedures for a complaint are in place.

Just to remind you that the basis on my complaints are the active discrimination of the disadvantaged which is a contravention of what has become known as the public benefit test and financial fraud.

The financial fraud comes from the use of fabricated allegations of plagiarism, malicious harassment, the fabrication and destruction of evidence, and perverting the students’ complaints procedure to eliminate complainers from the university. This conduct is concealed by the use of solicitors to threaten students who complain with legal action, high court injunctions, and a requirement to sign an undertaking never to tell the truth again.

This also has implications for the public benefit test as officers and staff are the only ones who benefit from free legal services to conceal their own corruption. Such ‘benefit’ is not extended to students who have to pay their own legal fees.

The current Administrator and Registrar Mr Tobias has confirmed that senior officers are going to continue with the concealment of past corrupt practices despite being given every opportunity and come clean in the interests of the University as a charity company.

In my opinion his actions clarify that this is a ‘corporate’ concealment of corruption which means that the University of Wales Lampeter is no longer operating as a charity in keeping with its stated charitable purpose of providing education? It seems that using charity funds to conceal corruption comes first and education comes second with evidence that this is also being corrupted.

In pursuing this matter in the public interest, I have revealed that the University of Wales Lampeter will petition for bankruptcy against any student who owes them more than £750 pounds in order to conceal corruption. The student would be offered a financial inducement to refrain from making is generally described as ‘defamatory comments’ which is a euphemism for the ‘truth’ to regulatory bodies and interested parties. This includes HEFCW, the QAA and the Office of the Independent Adjudicator for Higher Education (OIA). I have informed the OIA to this effect as there are clear implications concerning the perversion of the student’s complaints scheme, particularly if the student has knowledge of a criminal offence.

Under the circumstances I feel I should warn you that I have every reason to believe that the Charity Commission would be added to the list of organisations that any student would be ‘required’ to refrain from complaining to under threat and financial inducement. If the University of Wales Lampeter does not have any reasons to do this, they would make up allegations of malicious harassment etc. to justify their actions and legal expenditure.

The University of Wales Lampeter and Trinity College Carmarthen are going to merge, I have applied through UCAS to continue my education at Trinity College and I am aware my application is receiving serious consideration. I have submitted documentary evidence that I never committed any plagiarism so I can start with a clean sheet and obtain the evidence that Lampeter has concealed so I can take the appropriate action. From this comes the evidence of the tens of thousands of pounds spent on concealment of academic fraud and gross misconduct.

Trinity College has no reason to refuse me admission and such is covered by its own complaints procedures, moreover, admissions are more than likely to be within the brief of the OIA by September of this year. I have informed them of this situation so the Governors are fully aware of the situation and any liability they may face with regard to the merger with Lampeter.

I have written to both the President and Vice President of the University of Wales Lampeter asking if they intend to demonstrate the required leadership in this matter. It will also clarify the corporate liability issue on the sanction of having their charitable status withdrawn as well as any criminal offences reported to the police.
