Re: Perverting a Course of Public Justice for Students under the University of Wales Lampeter Complaints Procedures, and the ‘scheme’ as defined by the Higher Education Act 2004 administered by the Office of the Independent Adjudicator for Higher Education (OIA)
I am writing to you as President and Vice President of the University of Wales Lampeter University Council with regard to your duties as defined by the Chairmen of Universities Councils CUC, guidelines issues by HEFCW and the Nolan Committee on Standards in Public Life.
From your visits to my web site the Lamp Post, you are aware of the situation to which I refer, that is the deliberate and premeditated acts of stitching up students with false accusations of plagiarism in the knowledge that there is nothing a student can do to clear their name. In my case, there was also the incident of being intimidated during an examination.
The only thing this so-called university has succeeded in is to stitch me up by perverting a course of public justice for students under you student complaints scheme. What you have failed to do is provide any evidence to support any accusation of plagiarism. You have failed to make two and two equal five to conceal the corrupt conduct of officers and staff and fraudulent use of charity funds.
These issues have exposed the deliberate manipulation and falsification of the results obtained form the use of anti plagiarism software. From recent research, it is no exaggeration to say that as far as accuracy and consistency is concerned you could train a monkey to do better than that, claims that your accusations are amongst the highest standards in the university sector makes of mockery of Welsh higher education. These acts are committed to actively discriminate against the disadvantaged and those who complain.
The recent threat of a bankruptcy petition has also exposed the tactic of petitioning for bankruptcy against students who owe more than £750 with the intention of preventing them from exercising their lawful right to complain to any relevant body and in particular the OIA. This is done by with the fraudulent use of charity funds to instruct Eversheds to designate any complaint as being defamatory. This is followed by the thinly veiled threat of legal action, a high court injunction and a requirement to sign a legally binding agreement never to tell the truth again least of all to the OIA. In other words, the student keeps quiet about a possible criminal offence in return for some kind of financial inducement.
I remind you that under the Higher Education Act 2004 all Welsh students have privilege under the Defamation Act 1996 as all evidence is considered to be the same as if it were submitted to a court. In plain words, students can say what they like provided they believe it to be true.
I have made a formal application to Trinity College Carmarthen through UCAS within the time limit to continue my studies. I am entitled to say what I like as long as its true and to that effect I have submitted documents in support of the unfounded accusations of plagiarism made against me. Trinity College covers admissions in its complaints procedures and I believe that such will be included in the brief of the OIA in due course. However, not only is the University of Wales Lampeter perverting its own complaints procedures, they are also perverting the UCAS admission process to prevent a student from gaining entry into another University.
The problem for Trinity College Carmarthen is that they now have documentary proof that your university stitched me up; they are also concerned about the role of their past President as Visitor to Lampeter, if Trinity College want to be a part of this scandal that is a matter for them. The problem for you both is that night follows day and the Charity Commission will expose the obvious fraud that past and present officer and staff have tried to conceal. It seems that your officers and staff are up all night reading the Lamp Post in the knowledge that they are about to be caught out. There is also some anxiety within the Student Union around the organised sending of abusive emails and the mutual overlooking of corrupt practices that also merits proper inquiry. Moreover, I am not the only person who has made public claims to this effect. Mr Tobias says he has been unable to identify the perpetrator of this abuse and claims he is making further enquiries into the matter. Having failed to match an email address with a student name, he now knows where to look!
I refer you to your duties under the above guidelines and ask if you intend to demonstrate the required leadership in this matter. If you do, then you are going to expose financial and academic fraud, if you do not then others will do it for you.
The important thing is that you have received this letter and therefore, you have no excuses for not acting and you cannot blame anyone other than yourselves when you have to account for your actions in this matter.
