Re: Letter from the President and Vice President of the University of Wales Lampeter dated 4th February 2009 in which they ask you to respond to my letter dated 21st January 2009 as issues predate their appointments.

Dear Mr Tobias,

I am still waiting for you to confirm the identity of the person who sent the abusive emails; your promises of further inquiry seem to be meaningless. I fail to see what the problem is in matching an email address with the student concerned, unless of course you already know who it is and have decided to obstruct my right to take appropriate action in this matter. Condoning such behaviour is a corrupting influence so you are required to confirm if you know whom it is.

With regard to the request from the President and Vice President for you to respond to my letter dated the 21st January, it seems at first impression to be a case of shifting the responsibility.

However, upon reflection, it would appear that by expressing their deep concern and in distancing themselves from these matters, they have cast you adrift in stormy seas! They obviously know that that the game is up, so in that respect I must ask whether you intend to come clean or keep up the concealment of corruption in the vain hope that you can continue to bully your way out of it.

It is common knowledge that senior management at Lampeter are fully aware that there never was any plagiarism and that the student complaint procedures were obstructed and perverted. You all know that Zed Zorichak fabricated it and that senior management including you have concealed that fact. This establishes who is telling the truth and its not you. Moreover, failure to act is a wilful neglect of duty and misconduct in public office.

Following my application through UCAS to your merged partner Trinity College Carmarthen, you instructed Eversheds to make a financial inducement together with a threat in order to prevent these matters being investigated by Trinity College and the appropriate authority including the OIA.

You attempted to pervert the admission process to Trinity College to prevent me from being able to clear my name against your false accusations of plagiarism. Professor David Austin claimed the allegations were in the highest standards in the university sector, but the truth of the matter is that is that they would not pass an ofsted inspection for a day nursery. I am not sure how you have the temerity do such a thing unless of course it was a woeful act of desperation.

Moreover, you seem very confused about this issue of defamation. I am entitled to say what I like against your defamatory accusations of plagiarism and intend to do so. That you should attempt to make a requirement that I refrain from making ‘defamatory comments’ under threat from bully boys Eversheds is a total nonsense and a blatant act of corruption.

I have sent documentary evidence to Trinity College to prove my point so I can resume my education without your sleazy smears being made against me. I repeat my request that you send proof of your allegations of plagiarism; however, your evidence does not stand up to scrutiny, which is why everybody involved in my complaint went out of their way not to scrutinise it.

Trinity College Carmarthen includes admissions as part of their complaints procedures and is an issue that is being considered by the OIA. Your deliberate attempt to prevent me from complaining to the OIA is undermining the student complaints scheme and perverting a course of public justice for students.

I have also raised similar concerns with the Charity Commission that students who complain under the Charity Act 2006 are likely to get a threatening letter alleging without foundation that their complaints are defamatory, together with a thinly veiled threat of legal action.

Far from concealing these matters, you seem to have drawn attention to yourself from the Charity Commission, the OIA, Universities UK, the Welsh Assembly, the Cabinet Office, the DUIS and other UK government departments, HEFCW, the QAA, Trinity College, and a large number of Universities. I can only assume they are all asking the same question, what is going on. There are also serious concerns about the bullyboy conduct of Eversheds in this matter and its market dominance in higher education.

With regard to your response and on the assumption that you are still in post, I must point out to you that if you imply anything defamatory including false allegations of plagiarism or any other fabricated accusation such as malicious harassment, then I reserve my right to say what I like in reply and take the appropriate action.
Your crass attempt to keep the lid on the corruption at Lampeter has been a dismal failure for which you have been left by the University Council to take full responsibility. Therefore, I suggest that the only resolution in the interests of the University and me would be for you to refer the matter back to the Visitor with a request that he sets up an independent board of inquiry in keeping with the standards of natural justice set by the OIA.

Unfortunately, you seem to have put yourself in a corner having named the Visitor as one of the people to whom I am required to stop making what you claim without foundation to be ‘defamatory comments’. Under the circumstances, perhaps somebody else could make this decision for you. However, if that does happen, then I must insist that on this occasion you refrain from obvious collusion and fabrication of evidence to deprive me of a fair hearing. People only fear openness and transparency when they have something to hide.

Lastly, given the treatment I have received from the University of Wales Lampeter is common practice, I draw your attention to a page on student suicide published to the Lamp Post at this address http://www.lamp-post.info/suicide-risk/.

I suggest that for someone from the university to make returning visits to read this page in the middle of the night is an indication that you are in melt down. According to Durkheim’s theory of Anomie, when the rules breakdown suicide and deviant behaviour are more likely; so are charges of corporate manslaughter.
